FIRM ANNOUNCEMENTS
August 28, 2007 - Okin &
Adams recently assisted our client Newmont (USA), Ltd. and
its wholly owned subsidiary, Resurrection Mining Company,
in settling numerous, long-standing disputes related to the
California Gulch Superfund Site near Leadville, Colorado.
This settlement of more the $200 million in claims was reached
as part of the environmental claim estimation process which
is underway in the United States Bankruptcy Court for the
Southern District of Texas in Corpus Christi in the ASARCO,
LLC bankruptcy case.
United States Bankruptcy Judge Richard
S. Schmidt entered findings of fact and an order approving
this monumental settlement on August 28, 2007. Bankruptcy
Court approval was the final hurdle in the bankruptcy case.
The settlement between Resurrection/Newmont and the government
must now be finalized through the entry of a consent decree
in United States District Court in Colorado. Once the consent
decree is entered later this year, our clients will have achieved
what one of the lawyers representing a class of creditors
in the bankruptcy described as "a remarkable settlement
of an extremely complicated situation."

had been parties to a joint venture for the development and
